Government Takes On Nursing Homes Accused of Fraud; Are You a Victim?

The United States Government recently joined in on legal action (consolidating three complaints) against this national nursing home operator. ManorCare has about 280 skilled nursing facilities in the US, several in New Jersey. The three lawsuits state that ManorCare submitted bills to Medicare and Tricare for services that were not “medically reasonable and necessary,” according to the US Department of Justice.
“The Department of Justice is committed to ensuring that healthcare providers who pressure their employees to provide medically unnecessary services to Medicare beneficiaries and Tricare recipients solely to increase their own profits are held accountable,” said the Justice Department’s Civil Division Principal Deputy Assistant Attorney General Benjamin C. Mizer.
According to the government’s Complaint, ManorCare, owned by The Carlyle Group, allegedly pressured administrators and rehab therapists at individual nursing homes to provide unnecessary services to increase revenues from Medicare and Tricare patients. They were also told to keep patients in the facilities long after they should have been discharged so the company could bill more. Decisions were made, the DOJ says, “without regard to patients’ actual clinical needs.”
